Terms of Service

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the LangSwitcher application (the "Service") operated by Ihor Prodan ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

1. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install and use the LangSwitcher application on macOS devices that you own or control for personal or commercial use.

1.1 Scope of License

• You may use the Application on any macOS device that you own or control
• The license is granted for a single user or organization
• Direct version licenses are tied to specific devices
• App Store purchases follow Apple's standard licensing terms

2. License Restrictions

You agree not to, and you will not permit others to:

• Copy, modify, or create derivative works of the Application
• Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Application
• Rent, lease, lend, sell, redistribute, or sublicense the Application
• Remove, alter, or obscure any proprietary notice or labels on the Application
• Use the Application for any unlawful purpose or in any way that violates these Terms
• Share license keys with unauthorized users
• Attempt to bypass license verification mechanisms

3. Purchases and Payments

3.1 App Store Version

If you purchase the Application through the Apple App Store, the purchase is subject to Apple's Terms and Conditions and refund policies. We have no control over App Store transactions.

3.2 Direct Version

For the Direct version of the Application:

• All sales are final unless otherwise required by law
• License keys are non-transferable
• License activation requires a valid email address
• One license key is valid for one device
• Device transfers may be permitted at our discretion

4. License Activation and Verification

The Direct version of the Application requires online license activation and periodic verification:

• You must activate your license with a valid email address
• Your license will be tied to your device identifier
• The Application may periodically verify your license status
• Internet connectivity is required for activation and verification
• We reserve the right to deactivate licenses that violate these Terms

5. Updates and Maintenance

We may from time to time provide updates, bug fixes, or new features for the Application. Updates may:

• Be automatic or require manual installation
• Change, remove, or add features
• Require acceptance of revised Terms

We reserve the right to discontinue support for older versions of the Application.

6. Privacy and Data Collection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using the Service, you agree to our collection and use of information in accordance with our Privacy Policy.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• That the Service will be uninterrupted, secure, or error-free
• That defects will be corrected
• That the Service is free of viruses or other harmful components

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE LICENSE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify, defend, and hold harmless Ihor Prodan and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Service or violation of these Terms.

10. Export Restrictions

The Application may be subject to export laws and regulations. You agree not to export or re-export the Application to any country, person, or entity in violation of such laws or regulations.

11. Termination

We may terminate or suspend your license and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination:

• Your right to use the Application will immediately cease
• You must cease all use of the Application and delete all copies
• No refunds will be provided except as required by law

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of your jurisdiction of residence, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

15. Entire Agreement

These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have between us regarding the Service.
